These Terms and Conditions govern your use of Compea Mart, a comparison, discovery, and referral platform operated by Compea Ltd. By using the platform in any way you agree to be bound by these Terms in full. Compea Mart is not a retailer — products are sold by independent third-party sellers and transactions occur on seller websites.

1.1

Parties and Binding Agreement

These Terms and Conditions constitute a legally binding agreement between you (the “User”) and Compea Ltd, a company incorporated under the laws of Kenya, operating the Compea Mart platform. By accessing, browsing, searching, saving, comparing, or otherwise using the platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with the Privacy Policy, Cookie Policy, Disclaimer, and all other policies incorporated herein by reference. If you do not agree with any provision of these Terms, you must immediately discontinue your use of the platform. Compea Ltd reserves the right to amend these Terms at any time. Continued use of the platform following publication of updated Terms constitutes acceptance of those changes.

1.2

Nature of the Platform

Compea Mart is a comparison engine, discovery tool, and referral platform. Its sole purpose is to aggregate product and pricing data from third-party sellers, organise that data into comparable formats, and assist users in making informed purchasing decisions. Compea Mart is not a retailer in the ordinary sense. Except where explicitly stated to the contrary in a specific transaction, Compea Ltd does not sell products, hold inventory, set final retail prices, process payments, or fulfil orders. Compea Mart is not a party to any contract of sale between a user and a seller. The legal relationship for any purchase is formed exclusively between the user and the applicable seller, governed by that seller's own terms and conditions.

Platform Identity — Important

Compea Mart is a comparison, discovery, and referral platform. Products are sold by independent third-party sellers. Purchases are completed on third-party websites. Compea Ltd is not the seller, payment processor, delivery provider, or warranty provider in respect of any product listed on the platform.

1.3

Transaction Structure and User Flow

When a user identifies a product of interest on the platform, they are directed via an outbound link to the seller's website. At the point of departure from the platform, the user exits the Compea Mart environment entirely. Any contract of sale that arises from that visit is formed between the user and the seller. Compea Ltd has no involvement in, and assumes no liability for, that transaction. The user is solely responsible for reviewing the seller's terms, returns policy, and any other applicable terms before completing a purchase.

Data Sourcing and Accuracy

The platform aggregates product and pricing data from seller APIs, affiliate data feeds, publicly accessible web pages, structured web scraping, direct seller input, and third-party data aggregators. Compea Ltd may normalise, restructure, summarise, and present this data to facilitate comparison. While Compea Ltd makes reasonable efforts to maintain accuracy, it does not warrant that any information — including prices, stock availability, product specifications, images, or delivery timescales — is complete, accurate, current, or error-free at any given moment. The binding price and terms for any product are those presented on the seller's own checkout page at the time of purchase.

Decision Support Features

The platform may display rankings, comparison tables, badges (including "Cheapest", "Best Value", or "Top Pick"), and personalised recommendations. These outputs are generated by algorithmic and automated processes drawing on price signals, delivery signals, seller performance signals, user engagement data, and commercial arrangements. They are informational in nature and are intended to support, not replace, the user's own judgement. No ranking, badge, or recommendation constitutes a guarantee of product quality, seller reliability, price accuracy, or transactional outcome.

Pricing Disclaimer

Prices displayed on the platform are sourced from third-party sellers and may not reflect real-time pricing. Prices are subject to change without notice and may differ from those displayed on the seller's own website at the time of checkout. The price applicable to any transaction is the price confirmed at checkout on the seller's website. Compea Ltd accepts no liability for price discrepancies.

User Responsibilities

Users bear sole responsibility for: verifying the identity and legitimacy of any seller before completing a transaction; confirming the final price, taxes, and delivery charges on the seller's checkout page; reviewing the seller's delivery terms and coverage areas; understanding the seller's returns and refund policy; and satisfying themselves as to the suitability of any product for their intended purpose. Users must be at least eighteen (18) years of age to use the platform.

1.8

Intellectual Property

All content on the platform, including text, graphics, logos, icons, images, user interface design, software, and data compilation, is the property of Compea Ltd or its licensors and is protected by applicable intellectual property laws. Users are granted a limited, non-exclusive, non-transferable licence to access and use the platform for personal, non-commercial purposes only. No content may be reproduced, distributed, modified, or used for commercial purposes without the prior written consent of Compea Ltd.

1.9

Limitation of Liability

To the fullest extent permitted by applicable law, Compea Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from use of the platform, including product defects, delivery failures, seller fraud, pricing errors, warranty disputes, or refund failures. Where liability cannot be wholly excluded by law, the maximum aggregate liability of Compea Ltd to any user shall be limited to the greater of (i) KES 10,000, or (ii) the total amount paid by the user directly to Compea Ltd in the twelve months preceding the event giving rise to the claim.

1.10

Suspension and Termination

Compea Ltd reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or permanently terminate any user's access to the platform where it reasonably believes that the user has engaged in misuse, attempted fraud, violated these Terms, or posed a legal, financial, or reputational risk to Compea Ltd. Provisions that by their nature should survive termination — including limitations of liability, disclaimers, and governing law — shall continue in effect.

1.11

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya, save that Compea Ltd reserves the right to bring proceedings for injunctive or other equitable relief in any jurisdiction.
